EXPIN is not a medical device, diagnostic tool, therapeutic tool, or clinical decision support system, and it does not provide medical advice. It is an investigative tool that surfaces probable environmental, lifestyle, and medical exposures that peer-reviewed research associates with chronic conditions. It does not diagnose, treat, cure, or prevent any disease and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any medical condition or before making any health decision. If you are experiencing a medical emergency, call 911 or your local emergency number. See Section 6.
These Terms contain an arbitration agreement and a class-action waiver (Section 25) that affect how disputes are resolved. You may opt out of the arbitration agreement within 30 days of first accepting these Terms (see Section 25).
1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "User") and The Exposome Intelligence Company, a Delaware corporation ("EXPIN," "we," "us," or "our"). They govern your access to and use of the EXPIN platform, the expotype analysis and report, any related consultations and paid plans, and our websites at expin.ai and related subdomains (collectively, the "Service").
By accessing or using the Service, creating an account, purchasing a plan, submitting an application, or clicking to accept, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Definitions
- "Expotype" means the personalized report EXPIN generates mapping potential exposure–outcome relationships relevant to your history, including supporting references.
- "User Content" means information, responses, documents, and materials you provide to the Service, including interview responses and any health information.
- "Paid Services" means any features, plans, subscriptions, or analyses offered for a fee.
- "Subscription" means a recurring, automatically renewing plan.
- "Beta Features" means features or access offered on a beta, trial, preview, or other early-access basis (Section 16).
- "Represented Individual" means a person on whose behalf you use the Service (Section 10).
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is not directed to, and may not be used by, anyone under 18. By using the Service, you represent that you meet these requirements. The Service is for adults only, and you may not use it on behalf of, or submit any information about, a person under 18.
The Service is operated from the United States and is designed for users in the United States. We accept users located in many other countries, but the Service may not function correctly, and may not be appropriate, outside the United States; if you access it from elsewhere, you do so on your own initiative and are responsible for compliance with your local laws. The Service is not offered to, and may not be used by, residents of the European Economic Area (EEA), the United Kingdom, or Switzerland, and by using the Service you represent that you are not a resident of those regions. We expect to support those regions in the future.
4. The Service
EXPIN uses an AI-guided interview to collect a detailed exposure and life history, cross-references curated peer-reviewed scientific literature and toxicological, environmental, and public-health data sources, and generates an expotype intended to help you and your healthcare provider investigate potential contributors to your symptoms or diagnosed condition. The Service may also include limited human review and consultations with members of our team. The Service is designed to be used over time: we review, maintain, and refine your expotype and provide longitudinal insights as you add information and as new data and evidence become available, which requires us to access and process your information on an ongoing basis to deliver the Service to you. Some features are free and others are Paid Services (Sections 12–15). We may modify, add, or discontinue features of the Service over time.
5. What the Service is not
The Service is intended for informational and investigative purposes only. It does not:
(a) diagnose, treat, cure, or prevent any disease or condition;
(b) provide medical, clinical, or professional advice;
(c) constitute clinical decision support or establish a standard of care;
(d) create a doctor–patient, therapist–patient, or other professional relationship; or
(e) replace consultation with, testing ordered by, or treatment from a qualified healthcare provider.
6. Medical disclaimer; no reliance; emergencies
Information provided through the Service, including any expotype, identified exposures, references, or consultation discussion, is general and investigative and may be incomplete, inaccurate, or not applicable to you. Do not use the Service as a basis for making medical decisions without consulting a qualified healthcare provider. EXPIN is not responsible for any action you take or refrain from taking based on the Service. Never disregard or delay seeking professional medical advice because of something you encountered through the Service. If you think you may have a medical emergency, call 911 or your local emergency number immediately.
Results may be distressing. Your expotype may surface information about probable exposures and their possible links to serious or chronic conditions, and you may find some of it unexpected, upsetting, or difficult to read. Reviewing your expotype is a personal decision, and once you have seen it you cannot un-see it. Before using the Service, and before reviewing your results, consider whether you would prefer to do so with the support of a qualified healthcare provider or someone you trust, and seek professional guidance for any questions or concerns the results raise. The Service identifies probable and potential associations, not confirmed causes or a diagnosis.
7. AI-generated content and accuracy
The Service uses artificial intelligence, including third-party large language and vector embedding models, to conduct interviews and assist in analysis. AI systems can produce outputs that are inaccurate, incomplete, or not reflective of current science, and the expotype identifies probable and potential associations, not confirmed causes. We do not warrant the accuracy, completeness, reliability, or fitness for any purpose of any AI-generated output. You acknowledge the inherent limitations of AI and assume the risk of relying on any output. See our Privacy Policy for how AI providers process your information.
8. Accounts and registration
To use certain features you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly through our customer contact portal (available on our website and in the EXPIN app) if you suspect any unauthorized use. You may not share your account or transfer it to another person.
9. Acceptable use
You agree not to:
(a) provide information that is false, or that belongs to another person without authority;
(b) use the Service for any unlawful, harmful, or fraudulent purpose;
(c) attempt to access accounts, data, or systems without authorization, or probe, scan, or test the vulnerability of the Service;
(d) reverse engineer, decompile, scrape, or extract source code or underlying data except as permitted by law;
(e) interfere with or disrupt the Service or its infrastructure;
(f) use the Service to provide medical advice to third parties or to make clinical decisions about others except in your capacity as that person's parent, legal guardian, authorized representative, or licensed healthcare provider acting within your scope;
(g) misrepresent the nature of the Service (e.g., as a diagnostic or medical product);
(h) interfere with, manipulate, or attempt to circumvent the AI interview system or its safety, content, or operational controls (including through "jailbreak," prompt-injection, or similar techniques), or attempt to extract, expose, or reverse-engineer its underlying prompts, instructions, models, or training data;
(i) use the AI features for any purpose other than completing your own or your Represented Individual's health-history interview, including to generate content unrelated to the Service or any harmful, abusive, infringing, or unlawful content, or to cause the system to produce outputs outside its intended scope; or
(j) use the Service's outputs to train, fine-tune, or develop any competing model, dataset, or service, or to perform model extraction or distillation.
10. Acting for others; sharing with your healthcare provider
(a) Use on behalf of another person. If you use the Service on behalf of another person (a "Represented Individual"), you represent and warrant that you have the legal authority to do so and to provide that person's information and consents, including any consent to processing of health information. The Represented Individual must also be at least 18 years old. You are responsible for ensuring the Represented Individual is informed about the Service and our Privacy Policy. The data-subject rights described in the Privacy Policy belong to the Represented Individual.
(b) Sharing your expotype with your healthcare provider. You may choose to provide contact information for your healthcare provider so that we can send them a link to access your expotype. If you do, you authorize us to disclose your expotype and related information to the provider you designate, and you represent that the contact information you provide is accurate and that the recipient is your healthcare provider. You are responsible for the accuracy of the contact information you enter; if you provide incorrect information, your information may be delivered to the wrong recipient, and you accept that risk. We will contact the provider (for example, by email) to deliver the access link. Providing the link is done at your request and for the provider's reference only; it does not create any relationship between EXPIN and the provider, is not medical advice or clinical decision support, and the provider remains solely responsible for exercising independent professional judgment. The provider's access may be subject to terms presented at the time of access. You may disable or revoke provider access at any time through our customer contact portal.
(c) Terms for providers accessing a shared expotype. If you are a healthcare provider accessing an expotype through a link shared with you, this subsection applies to your access, and by accessing the expotype you agree to it. The expotype is provided to you at the patient's request and for your reference only. It is investigative; it is not a diagnosis, treatment recommendation, medical advice, or clinical decision support, and it does not create any relationship between you and EXPIN. You remain solely responsible for exercising your own independent professional judgment. You agree to keep the information confidential, to use it only to support the care of the patient who shared it, and not to copy, retain, or further disclose it except as needed for that purpose or as required by law. EXPIN makes no warranties to you regarding the expotype, and your access may be limited in scope, time-bound, or revoked at any time.
11. Consents
(a) Use of your information. Your use of the Service involves the collection and processing of sensitive information, including health information. Our handling of your information is described in the Privacy Policy. Providing the Service to you, including accessing, reviewing, and processing your information to create, maintain, refine, and personalize your reports and longitudinal insights over time, is part of the Service you request and does not require separate consent. Separately, where we use your information to develop or train our models or to improve the Service for users generally (beyond providing and refining the Service for you), we rely on a separate, opt-in consent given through the mechanisms described in the Privacy Policy, which may be withdrawn as described there. Withdrawing that separate consent does not, by itself, end your ability to use the core Service, though withdrawing consents necessary to provide the Service may.
(b) Communications; consent to be contacted. By providing your contact information, you consent to receive communications from us by email, SMS/text message, telephone call, and physical mail at the contact details you provide. These may include messages about your account, application, expotype, scheduling, billing, security, and other matters related to the Service, and, where permitted by law, informational and promotional messages. You agree that calls and text messages may be made or sent using automated technology, including autodialers and prerecorded or artificial-voice (including AI-generated) messages.
Message frequency varies, and message-and-data rates may apply. You may opt out of promotional communications at any time by replying STOP to a text message, using the unsubscribe link in an email, asking to be placed on our internal do-not-call list, or contacting us through our customer contact portal; we may still send transactional or service-related messages necessary to provide the Service. You represent that you are the owner or an authorized user of the contact information you provide, that you will keep it current, and that you will notify us if a telephone number you gave us is reassigned.
Consent to receive marketing or promotional autodialed or prerecorded calls or text messages is not a condition of purchasing or using the Service.
12. Plans, fees, and payment
(a) Pricing. We offer the Service through one or more free and Paid Services. Current plans, features, and prices are presented at the point of purchase. Prices are in U.S. dollars and exclusive of taxes unless stated.
(b) Authorization to charge. When you purchase a Paid Service, you authorize us and our payment processor(s) to charge your designated payment method for all applicable fees and taxes. You represent that you are authorized to use the payment method you provide.
(c) Payment processors. Payments are processed by our third-party payment processor(s). Your use of those services is subject to their terms, and you are responsible for keeping your payment information accurate.
(d) Taxes. You are responsible for any applicable sales, use, VAT, or similar taxes, which we may collect where required.
(e) Failed payments. If a charge fails, we may retry, suspend, or terminate access to Paid Services until payment is made.
13. Subscriptions, automatic renewal, and cancellation
Please read this section carefully. Subscriptions renew and bill automatically until canceled.
(a) Automatic renewal. If you purchase a Subscription, it will automatically renew at the end of each term, and your payment method will be charged the then-current price for the next billing period, unless you cancel 10 days before the renewal date. Any first-year promotional discount (see Section 14) applies only to your initial term; renewals are charged at the then-current standard price.
(b) How to cancel. You may cancel at any time using the self-service cancellation option in your account settings in the EXPIN app or on our website (a method at least as easy to use as the one you used to subscribe) or, if you prefer, by contacting us through our customer contact portal. Cancellation takes effect at the end of your current annual term: you will keep access until then, and your Subscription will not renew for the next year.
(c) Renewal reminders and notices. We will send renewal reminders and notice of upcoming charges and any material changes before they take effect generally at least 30 days before each annual renewal, or as otherwise required by law.
(d) Price changes. We may change prices. For Subscriptions, changes apply to the next term after we give you advance notice and, where required, obtain your consent. If you do not agree, you may cancel before the change takes effect.
14. Free trials, discounts, and promotional offers
(a) Trials. We may offer free or discounted trials. Unless stated otherwise, at the end of a trial we will begin charging the applicable fees (including by converting a trial to a paid Subscription) unless you cancel before the trial ends. The terms of each trial will be disclosed when offered.
(b) Early-supporter and other discounts. We may offer promotional pricing, such as a discount on the first year for early supporters. Discounts apply as described at the time of the offer, may be limited in time or quantity, are not transferable, and may be modified or discontinued. Unless stated otherwise, a discount applies only to the initial term, and standard pricing applies on renewal.
15. Refunds
Fees are non-refundable, and we do not offer prorated or partial refunds for unused time, features, or downgrades. If you cancel a Subscription, you will keep access to the Service, including your expotype and related data, through the end of the billing term you have already paid for, after which your access ends and you will no longer be able to access your expotype. If you would prefer to have your information deleted immediately rather than at the end of your paid term, you may request deletion at any time through our customer contact portal (see the Privacy Policy for how deletion works). Nothing in this section limits any non-waivable refund or cancellation rights you may have under applicable consumer-protection law.
16. Beta and early-access features
From time to time we may make Beta Features available.
(a) As-is. Beta Features are provided on an "as is" and "as available" basis, may contain errors or change or be removed at any time, and may be subject to additional or different terms presented to you.
(b) Participation. Access to Beta Features is at our discretion, and we may add, decline, suspend, or remove participants or end a beta or trial at any time.
(c) Feedback expected. If you use Beta Features, you agree to provide honest feedback about your experience as described to you.
(d) No guarantee of future access or pricing. Beta or trial access does not guarantee continued access. Continued or future access may require payment at then-current prices, subject to Sections 12–14.
17. Feedback
If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant EXPIN a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate the Feedback for any purpose without obligation or compensation to you. Feedback is not confidential.
18. Intellectual property; your content
(a) EXPIN IP. The Service, including all software, models, content, text, designs, and the format and presentation of the expotype, and all related intellectual property, are owned by EXPIN or its licensors and are protected by law. Except for the limited rights expressly granted here, we reserve all rights.
(b) Limited license to you. Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and your expotype for your own personal, non-commercial purposes (including sharing your expotype with your own healthcare provider).
(c) Your User Content. You retain ownership of your User Content. You grant EXPIN a worldwide, non-exclusive license to host, store, process, reproduce, and use your User Content to operate and provide the Service to you and as otherwise described in the Privacy Policy. Any additional use of your information to improve the Service or develop models is governed by the separate consent described in Section 11.
(d) Aggregated and de-identified data. We may create and use de-identified and aggregated data derived from use of the Service as described in the Privacy Policy.
19. Third-party services
The Service relies on and links to third-party services (for example, reCAPTCHA and the Google Privacy Policy and Terms of Service, cloud hosting, payment processing, communications, and AI providers). We are not responsible for third-party services, and your use of them may be subject to their terms. The material categories of third parties that process your information are described in the Privacy Policy, which we keep current.
20. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. EXPIN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT RESULTS WILL BE ACCURATE OR RELIABLE, OR THAT ANY EXPOTYPE WILL IDENTIFY ALL RELEVANT EXPOSURES OR ANY ACTUAL CAUSE OF A CONDITION.
21. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EXPIN AND ITS OFFICERS, EMPLOYEES, ADVISORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXPIN'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EXPIN IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
22. Indemnification
You agree to indemnify and hold harmless EXPIN and its officers, employees, advisors, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms or any law, your User Content, or, if applicable, your use of the Service on behalf of a Represented Individual without proper authority.
23. Term and termination
These Terms apply while you use the Service. You may stop using the Service and cancel any Subscription at any time (Section 13). We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms, non-payment, or discontinuation of the Service or a feature. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 6, 7, 11, 12(b), 15, 17, 18, 20–22, 25, and 26) will survive. We do not provide prorated refunds; when your access ends you will lose access to your expotype, and you may request immediate deletion of your information through our customer contact portal. Information handling after termination is described in the Privacy Policy.
24. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms with a new effective date and notifying you by email and/or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance.
25. Dispute resolution; governing law
Please read this section carefully.
(a) Informal resolution. Before filing any claim, you agree to contact us through our customer contact portal (available on our website and in the EXPIN app) and attempt in good faith to resolve the dispute informally for at least 90 days.
(b) Governing law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except to the extent the Federal Arbitration Act governs arbitration.
(c) Arbitration agreement and class-action waiver. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. The Federal Arbitration Act governs this agreement to arbitrate. You and EXPIN waive the right to a jury trial and waive any right to participate in a class, collective, consolidated, or representative action. The arbitrator decides all issues, except that a court decides the enforceability of the class-action waiver. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by submitting an opt-out request through our customer contact portal; if you opt out, the rest of this Section 25 still applies.
(d) Coordinated or mass filings. If 25 or more arbitration demands of a substantially similar nature are submitted by or with the coordination of the same or coordinated counsel, the parties agree the demands may be administered by AAA in batches consistent with its rules and any applicable mass-arbitration or multiple-case procedures, with the goal of resolving them efficiently.
(e) Venue for non-arbitrable claims. To the extent a claim is not subject to arbitration, the state and federal courts located in Hillsborough County, Florida will have exclusive jurisdiction, and you consent to personal jurisdiction there.
26. Miscellaneous
(a) Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and EXPIN regarding the Service.
(b) Severability. If any provision is unenforceable, the remaining provisions remain in effect.
(c) No waiver. Our failure to enforce a provision is not a waiver.
(d) Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
(e) Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
